Roxy Clinic Is Still Open and Providing Care

Following the 5th U.S. Circuit Court of Appeals' ruling on May 1, 2026 — which affects how mifepristone can be prescribed through telehealth and sent by mail — Roxy Clinic is still open and providing abortion care.

Are abortion pills still available?

Yes. The 5th Circuit's May 1 ruling specifically restricts how mifepristone can be sent through the mail under the FDA's 2023 telehealth rule. It does not change whether abortion is legal in your state, and it does not eliminate access to abortion care.

Telehealth abortion providers, including Roxy Clinic, are reviewing the ruling and adapting our protocols to continue serving patients. We will share full details about how we are continuing to provide care on Monday, May 4.

What the 5th Circuit ruled

On Friday, May 1, the 5th U.S. Circuit Court of Appeals temporarily blocked a 2023 FDA rule that allowed mifepristone — one of the two medications used in a medication abortion — to be prescribed through telehealth and sent by mail. The ruling reinstates a federal requirement that mifepristone be dispensed in person.

A few things worth knowing:

  • This is a temporary order issued while the case continues. It is not a final decision.
  • It can be appealed to the U.S. Supreme Court.
  • The FDA's own ongoing safety review of mifepristone is separate and still in progress.
  • It does not change the laws in your state about whether abortion is legal where you live.
  • It does not affect misoprostol, the other medication used in a medication abortion.
